Lindsay Lohan's Lawsuit Battle With GTA V Creator Take-Two Ends

New York's Court of Appeals issued a ruling today on actress Lindsay Lohan's lawsuit against Take-Two alleging her likeness was appropriated without permission in Grand Theft Auto V, and that ruling is: "dismissed".

Lindsay Lohan kicked off a lawsuit against the game developer for not only using her likeness for the cartoons, but also for creating another character, Lacey Jonas, which she said was similar to her life.

NY state Court of Appeals dismissed Lindsay Lohan's claim that a character in "Grand Theft Auto V" was based on her. Lohan in the suit claimed her image, voice and even clothing style had been lifted for the game.

After fighting a long battle with GTA V publisher Take-Two, Lindsay Lohan has lost. In its ruling, the court held that the "actress-slash-singer" featured in the game merely depicted a generic young woman in her 20s, the Washington Post wrote, and does not conclusively identify with Lohan.

But the state Court of Appeals ruled Thursday that the satirical representations of "a modern, beach-going" young woman are not identifiable as Lohan. The lawsuit was filed in 2014 and a judge originally ruled it could go forward, but that decision was overturned in 2016 by an appeals court that ruled Lohan's privacy wasn't violated because the game didn't use her actual name, portrait, or picture.

"We conclude a computer generated image may constitute a portrait within the meaning of that law", the verdict reads.

Neither the actress, nor Take Two Interactive Software have responded to requests for comment.

The Grand Theft Auto franchise has almost always used a good looking, scantily clad, suggestive cartoon women in their promotional material or for loading scenes. Reality TV star Karen Gravano claimed a different character in the game was based on her but that case was rejected.
